  • Module 2A: The Stages of the Mediation Process: A Step-by-Step Guide. Gain a practical roadmap from opening statements to negotiation and closing.

  • Module 2B: Understanding the Mediation Act, 2023. Crucial insights into the legal framework governing mediation in India, including enforceability.

  • Module 3A: Voluntary vs. Mandatory Mediation: A Critical Analysis. The distinction between voluntary and court-mandated mediation is a crucial real-world issue. This module addresses a central debate in the field, equipping participants to handle the different dynamics and challenges that arise when parties are at the table by choice versus by legal compulsion.

  • Module 3B: Essential Communication and Negotiation Techniques for Mediators. This is the mediator's practical toolkit. Theoretical knowledge has little value without the ability to manage difficult conversations. This module focuses on vital skills like active listening, reframing hostile language, and asking powerful questions, which are essential for navigating emotional deadlocks and facilitating constructive dialogue.

  • Module 4A: Mediation in Family Law. Family disputes are one of the most common and emotionally intense areas of mediation.   • Module 6A: Introduction to Investor-State Mediation. This module exposes participants to the world of high-stakes international disputes between foreign investors and sovereign states. While a niche area, it showcases the immense scalability of mediation skills and provides insight into a prestigious field of practice at the intersection of international law, commerce, and diplomacy.

  • Module 6B: The Role of Mediation in Insolvency With India's focus on the Insolvency and Bankruptcy Code (IBC), mediation is becoming a vital tool for resolving complex multi-party disputes between creditors and corporate debtors.   • Module 7A: The Art of Drafting the Mediated Settlement Agreement (MSA) The entire mediation effort culminates in this document. A weak or ambiguous MSA can render the entire process meaningless. This highly practical module provides the essential technical skill of translating the parties' verbal consensus into a precise, comprehensive, and legally robust written agreement.

  • Module 7B: Legal Framework for the Enforcement of MSAs. An agreement is only as powerful as its enforceability. This module closes the loop by explaining the legal process for making an MSA as binding as a court order under the Mediation Act. It gives participants and their future clients confidence in the finality and authority of the mediated outcome.

 

Day 8: Sunday, Oct 5, 2025

  • Module 8A: Building a Career and Practice in Mediation. This session answers the crucial question: "What now?". It shifts the focus from theory to business, providing participants with a practical roadmap on how to get empanelled, market their services, and build a sustainable professional practice, turning their new qualification into a viable career.

  • Module 8B: Concluding Session: Panel Discussion with Experts & Future Trends. This capstone module synthesises the entire course. An interactive panel with the course experts allows participants to clarify complex questions and gain diverse perspectives. By also looking at the future of dispute resolution, it ensures participants leave not just with knowledge of the present but also with an eye towards the evolving landscape of their new profession.
